On this page 5 sections

Track one: the limited federal action

The controlling text, effective provisions, registration requirements, and application to a particular business require current legal review.

Track two: the broader proceeding

As of August 11, 2026, the matter remains an active proceeding. Recheck the DEA docket and obtain current legal advice before applying it to an account or business decision.

What a broker should recheck

  • The exact entities, products, activities, licenses, locations, and jurisdictions involved
  • Any change to banking, tax, research, pharmacy, vendor, contract, or interstate plans
  • Applications, warranties, exclusions, territory, definitions, and prior disclosures
  • New landlord, lender, investor, customer, regulator, or counterparty requirements
  • Current legal and tax advice specific to the operation

Keep the two tracks separate in the account record

Record which federal action a business decision relies on, the source and date checked, the product or activity involved, and the qualified adviser responsible for the legal or tax conclusion. Do not carry a conclusion from one product, license, entity, or jurisdiction into another without reviewing the actual facts.

For insurance, update the application and policy review only when the operation, disclosure, contract, or requested coverage has changed. A federal headline by itself does not show that a carrier, form, exclusion, price, or claim position changed.

  • Identify the exact product, activity, entity, license, and jurisdiction
  • Record the federal source, checked date, and current legal advice
  • List resulting changes to contracts, operations, disclosures, or plans
  • Compare those changes with the actual application and policy wording

Use controlling primary sources for legal or regulatory status. Reported context is attributed separately and should not replace the operative document.
