# What post-hearing briefs do, and do not, mean for cannabis insurance

Post-hearing briefs can sharpen the arguments in the broader marijuana proceeding. They do not create a final rule, an effective date, nationwide legalization, or an automatic insurance result.

Account brief

## What to know

**A hearing record is not a final rule**

The conclusion of testimony and filing of post-hearing briefs are steps in the broader administrative proceeding.

**Put business reactions on the account record**

A cannabis business may change expansion, acquisition, financing, tax, medical, research, pharmacy, product, or contract plans before the government completes the broader proceeding.

**Use reporting for discovery and primary sources for status**

Marijuana Moment's hearing coverage is useful for following the proceeding and identifying new orders, disputes, and deadlines.

## A hearing record is not a final rule

A brief organizes a participant's position around the record; it does not itself create a final rule, effective date, nationwide legalization, or change to an insurance policy.

The exact sequence after briefing depends on the controlling orders and administrative record. A recommendation, agency action, publication, litigation, and effective date are separate events that should be verified separately.

## Put business reactions on the account record

The insurance question is whether those decisions change the entities, operations, values, territory, representations, or requested coverage in the account.

- Identify the official source and date behind each material assumption

- Name the qualified adviser responsible for a legal or tax conclusion

- Describe resulting changes to operations, contracts, values, ownership, or territory

- Reconcile those changes with applications, schedules, warranties, and prior disclosures

## Use reporting for discovery and primary sources for status

Attribute that reporting when relying on it, then connect a legal-status statement to DEA, the Federal Register, the actual order, or another controlling source.

That source discipline makes the article easier to update and reduces the risk that a summary headline is mistaken for the operative legal document.

## What not to infer from a filing

- That the broader proposal has been adopted or has a particular effective date

- That adult-use marijuana is federally legal or every federal-state conflict is resolved

- That Section 280E no longer applies to every business or tax period

- That banking, research, interstate commerce, employment, or licensing questions are settled

- That an insurer changed appetite, price, exclusions, wording, or a claim position

## The practical CARMA view

A disciplined account record is more useful than a prediction. Separate verified facts, planned changes, assumptions, and open legal or tax questions, then update the insurance discussion when the operation or requested decision actually changes.

## Sources

Use controlling primary sources for legal or regulatory status. Reported context is attributed separately and should not replace the operative document.

Only an issued policy and its endorsements can provide coverage, and their actual terms, conditions, limitations, and exclusions control. Laws, licensing, appetite, carrier participation, and external sources can change, so confirm time-sensitive matters with CARMA, the controlling source, and qualified advisers.
